TRIBUTE BOOK ORDER
It is your responsibility to ensure that those wishing to purchase and/or receive the personalised tribute book are also made aware of these Terms and Conditions.
1.Use of this website and/or placing an order indicates your agreement to abide by these True Star Terms & Conditions, and if you do not wish to abide by these Terms & Conditions you may not and should not access or use this website or place an order by post. By clicking on the button I AGREE  or by placing an order you are confirming that you have read and accepted the True Star TERMS & CONDITIONS on your own behalf and on the behalf of all recipients of the ordered Personalised Tribute book/s and that you and they will comply with and be bound by the Terms & Conditions which govern the True Star relationship with all concerned. 

2.The True Star website has been designed to show the reader an example of our (Family Memories & In Loving Memory) tribute books and to advise on the price structure, to assist you in choosing a book to meet your requirements and budget. Internet shopping is not yet available although you are able to print the Order Form and Page Template forms to complete at your leisure. 

3.True Star uses their standard templates and selected fonts, variations of which are not optional. Examples are shown to demonstrate available page options, images, font sizes and styles utilized may be changed without notification. 

4.The right to cancel your contract (order) and/or return products does not apply on personalised items, those made to your specifications and monies paid are non-refundable.

5.The payment method is by cheque or bank transfer (see Order form for details) 

6.It is your responsibility to ensure that True Star receives with the order, all completed page forms, all photographs, sympathy cards, floral tribute cards and all other inserts for copying with your cheque (or bank transfer) for 50% of the Order Total made payable to True Star. ( True Star Unit K, Tylers Cross Nursery, Epping Road, Nazeing, Waltham Abbey, Essex EN9 2DH ). 

7.True Star does not correct the condition of photographs and documents supplied by you and are not accountable for the variances of these or of scanned outputs which may differ from the originals in slight colour variation. 

8.It is your responsibility to ensure that poems, other text, documents and images supplied by you do not infringe copyright as True Star will not be held accountable for any issue resulting from the inclusion of these items. 

9.True Star may charge an administration fee up to a maximum of 20% of the order total plus the insert costs for each subsequent request for additional inclusions or amendments after the initial package of forms and inserts for copying have been received, and will not accept requests for additions or amendments once the Proof Declaration has been signed as approved. 

10.Tribute Book covers are Burgundy in colour as standard, the shades of which will differ depending on the chosen material. Where no specific colour or material has been ticked on the order form, it will be deemed that the order is for a cloth book/s with a Burgundy cover/s. - by cloth True Star means a cloth material which based on availability may or may not be grained- True Star mean bonded/reconstituted leather. 

11.It is your responsibility to ensure that the Proof document is checked and that the information, spelling and the use of the photographs, images and documents are correct and acceptable, and that any corrections are identified to True Star in writing, as the order will not be completed without the Proof Declaration signed by you.

12.It is your responsibility to pay the order balance at the time of returning the signed Proof Declaration as True Star will not be obligated to produce the Tribute Book/s until after True Star has received the signed declaration and is in receipt of all monies owed. 

13.You and the other recipients will become the owner of the Personalised Tribute Book/s after your final payment has been processed. Transfer of ownership of the Personalised Tribute Book/s is not a transfer of intellectual property rights or rights to the copyright material and therefore reproduction of the book/s is strictly prohibited. 
	
14.If you are placing an order with a third party (for example a funeral director) and making payment/s directly to them, True Star will not be obligated to produce the Tribute Book/s unless True Star has received the Proof Declaration signed by both yourself and countersigned by the third party and has received the full payment from that third party. In this instance the third party is the customer of True Star and True Star will not be liable for any issues as a consequence of their service to you. Delivery will be within 28 days of True Star being in receipt of the order balance payment and your signed Proof Declaration. 

15.If you are placing an order directly with True Star, delivery will be made within 28 days from the date that the order balance cheque or bank transfer has cleared and only where True Star is in receipt of your signed Proof Declaration. 

16.Personalised Tribute Books are weighed to confirm that the package being sent includes the number of books ordered, and checked to ensure that the original inserts have been included. 

17.True Star returns all received original photographs, sympathy cards, floral tribute cards and all other inserts with the Tribute Book/s by recorded delivery to your specified address and distribution then becomes your responsibility. 

18.True Star is not liable for the loss of original photographs, cards and documents once the package has been passed to Royal Mail.

19.Once the goods have been delivered to you they will be held at your own risk and True Star will not be liable for their loss, damage or destruction, and do not offer any warranty with regard to the durability of the Tribute Book/s. 

20.The goods will only be replaced if damaged in transit from True Star to your specified address and Royal Mail accepts full liability. To obtain a replacement order you must notify True Star in writing within 7 days of receipt, state the damage and return with your letter the whole order (regardless of its condition) including the original packaging. 

21.True Star will not accept liability for any costs incurred other than providing you with the said replacement. - Replacement means ordered version. - Damaged means cover and pages (not Proof agreed contents or the original photographs, sympathy cards, floral tribute cards and/or all other inserts supplied by you). - Whole Order means Tribute Book/s (not the original photographs, sympathy cards, floral tribute cards and all other inserts). 

22.Where the Proof Declaration and your final cheque (or bank transfer) have not been received within three months, True Star will return the supplied inserts by Recorded Delivery to your specified address and will archive the order for a period of not less than six months. In addition to any monies owed, reinstatement of the order will result in a £50 administration charge and the order will be subject to price increases.

23.These items are all hand-made to order and therefore some variations due to materials and finishing during manufacture is to be expected. 

24.It is agreed by all parties that True Star will print or engrave their company web address on the back cover of produced personalised tribute books and will include its copyright statement on at least one page of each book. 

25.True Star own the Intellectual Property rights to the Personalised Tribute Books which includes True Star Copyright Material, therefore reproduction of part or all of those contents in any form is strictly prohibited. 

26.Page details may be disclosed to third parties for the purpose of production. 

27.True Star is not responsible for the contents or actions of any third-party site to which links are included from its site. True Star has no control over and accepts no liability in respect of materials, products or services available on any other website which is not under the control of True Star.

28.28.True Star may amend its products, prices, BAND A and BAND B page discounts and Terms & Conditions without prior notice and will publish these changes on its website, the details of which will supersede advertised information.  Images on the website may not reflect the actual product material.  
 
29.Your statutory rights as a consumer are not affected by these Terms & Conditions.
